Terms of Service

CAI Global Solutions Nepal — Last updated May 2025

DoCSCP E-Commerce Notice

CAI Global Solutions Nepal is registered as an e-commerce business in compliance with the Electronic Transaction Act 2063 and the E-Commerce Act 2081. We are in the process of listing on the Department of Commerce, Supplies and Consumer Protection (DoCSCP) e-commerce portal. Listing reference: Pending registration per E-Commerce Act 2081.

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and CAI Global Solutions Nepal ("Company", "we", "us"), a business entity operating under the Nepal Companies Act 2063.

By accessing or using any service offered by CAI Global Solutions Nepal, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use our services.

2. Services

CAI Global Solutions Nepal provides the following categories of digital services:

Web Hosting and VPS: Shared hosting, virtual private servers, and managed server solutions.
Domain Registration: Registration and management of domain names through accredited registrars.
Software Subscriptions: Resale of third-party software licences and SaaS subscriptions.
Gaming Products: Digital game codes, top-up credits, and in-game currency for supported games.
Digital Marketing: SEO, social media management, content creation, and paid advertising services.
IT Consulting: Technology advisory, system integration, and project management services.

Service availability may vary by region. We reserve the right to modify or discontinue any service with 30 days notice.

3. User Accounts

Eligibility: You must be at least 18 years of age, or 13 years of age with verifiable parental consent for gaming services only.
Accurate Information: You must provide accurate, current, and complete information during registration and keep it updated.
Account Security: You are responsible for all activity under your account. Use a strong password and do not share your credentials.
One Account Per Person: Creating multiple accounts to circumvent restrictions, obtain duplicate promotions, or evade a ban is prohibited.
Termination: We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice depending on severity.

4. Payment Terms

Currency: All prices are listed in Nepali Rupees (NPR) or USD where indicated. Applicable taxes (VAT/PAN) are included or shown separately at checkout.
Payment Methods: We accept credit/debit cards, eSewa, Khalti, and bank transfers as listed at checkout.
Billing Cycle: Subscriptions are billed in advance on a monthly or annual cycle as selected during purchase.
Auto-Renewal: Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date. Cancellation instructions are available in your account dashboard.
Price Changes: We may adjust prices with 30 days advance notice. Continued use after the effective date constitutes acceptance.
Failed Payments: If a payment fails, services may be suspended after a 7-day grace period. You will be notified by email.

5. Prohibited Use

You agree not to use our services for any of the following:

Illegal Activity: Any activity that violates Nepali law, including the Electronic Transaction Act 2063, Cybercrime Act, or Consumer Protection Act 2075.
Harmful Content: Hosting, transmitting, or distributing malware, spyware, ransomware, or other malicious code.
Spam and Abuse: Sending unsolicited bulk communications, phishing attempts, or abuse of email infrastructure.
Intellectual Property Infringement: Reproducing, distributing, or using copyrighted content without authorisation.
Fraudulent Activity: Chargebacks without legitimate basis, false disputes, or misuse of gaming top-up services.
Hate Speech and Harassment: Content that promotes discrimination, incites violence, or harasses individuals or groups.
Resource Abuse: Actions that degrade shared infrastructure, including cryptocurrency mining on shared hosting.

Violations may result in immediate account termination and reporting to relevant authorities.

6. Intellectual Property

All content on our platform — including but not limited to logos, design, text, software code, and documentation — is the property of CAI Global Solutions Nepal or its licensors and is protected under applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to access and use our services for their intended purpose. You may not copy, modify, distribute, sell, or lease any part of our services or underlying software.

Third-party software licences and game codes purchased through our platform are governed by the respective publisher or developer end-user licence agreements (EULAs).

7. Limitation of Liability

To the maximum extent permitted by Nepali law, CAI Global Solutions Nepal shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.

Our total aggregate liability for any claim related to our services shall not exceed the amount you paid to us in the 3 months preceding the event giving rise to the claim.

This limitation does not exclude liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

8. Governing Law

These Terms are governed by and construed in accordance with the laws of Nepal, including the Nepal Companies Act 2063, the Electronic Transaction Act 2063, the Consumer Protection Act 2075, and the E-Commerce Act 2081.

Any legal action arising from these Terms must be brought in the courts of competent jurisdiction in Kathmandu, Nepal.

9. Dispute Resolution

We encourage resolution of disputes through direct communication first. Please contact us at caiglobasolutions@gmail.com with a description of your concern.

If a dispute cannot be resolved informally within 30 days, either party may refer the matter to mediation under the Arbitration Act 2055 of Nepal before initiating formal legal proceedings.

Consumers also retain the right to submit complaints to the Department of Commerce, Supplies and Consumer Protection (DoCSCP) under the Consumer Protection Act 2075.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify registered users by email at least 14 days before material changes take effect. Your continued use of our services after the effective date constitutes acceptance of the revised Terms.
